The SBAC Bankruptcy system has everything you'll need to get started including where to take your classes online. Take the first of the two mandatory classes, "Credit Counseling" required by the US Bankruptcy Court online. The certificate of completion, when completed online, will automatically be sent to the document processing company. The SBAC has the largest accredited school in the US to provide both classes usually $100.00, SBAC cost $69.00. (After the 341 meeting you will have 45 days to complete the 2nd class and send the certificate of completion to the trustee.) If you can not take the class online there are other venues available but they do have an additional cost. We included where to get your free credit report from Trans Union, Equifax and Experian. With this information it's easy to complete the information required in the SBAC system.. Again usually a lawyer will charge you $100.00 for a credit report.

We then contracted with one of the finest document preparation companies. Known nationally by US trustees as the "best of the best". When your documents arrive they will call you to go over your information.  They will then prepare your bankruptcy petition document for the court. They provide SBAC clients this service for only $75.00. Most online companies charge from $200.00 to $500.00 for this service. When your documents are returned from the preparation company,  review them for accuracy, put a stamp on the envelope and send it to the Federal Bankruptcy Court in your area, with your money order for $299.00 to file your bankruptcy petition. You may also bring it to the clerk of courts and receive your case number. When creditors call give them the case number and where you filed. Don't provide more information, that's all they need to know. From there the court takes over. Within 20 to 40 days the court will send a letter to everyone of your creditors telling them you are under Federal Bankruptcy Protection and they must stop all proceedings against you, stop calling and sending you letters. This will stop all garnishments, repossessions, foreclosures, legal actions and collections. If a creditor continues to contact you, they may be fined by the court. Simply notify the your clerk of courts and they will handle this for you. If you are in foreclosure, you will be able to stay in your home until the trustee releases your property to the bank. In bankruptcy your home, one vehicle and your personal belongings are usually exempt from creditors.

A few weeks after your filing the Trustee assigned to your case will send you an invitation to attend the 341 meeting of the creditors. You must attend this meeting or your Bankruptcy will be dismissed. The letter will outline what you must bring to the meeting. The Trustee will ask you a few questions; the answers will be neatly arranged in your SBAC Bankruptcy System. If you had a lawyer at this meeting they can not testify on your behalf. This meeting usally takes 10 to 20 minutes. After the 341 meeting you will have 45 days to complete the 2nd class and send the certificate of completion to the trustee. Your discharge will be mailed to you and your creditors in a few weeks. You are now on your way to rebuilding your future.
