BANKRUPTCY CHECKLIST

What should I Bring?

The purpose of this list is to help you focus on what information we will need to quickly and accurately evaluate your situation.  If you can not find all the items on this list, don’t get upset, we will discuss any missing information in our meeting.  Please try to locate the following:

 _____  Copies of your state and federal tax returns for the past 3 years, including W2s, 1099s,  etc.

 _____  Copies of your last six months of payroll check stubs.

______  If you own real estate, a copy of the Deed, the mortgage papers you signed at the time of buying the real estate and the payoff on the mortgage

_____  If you have a recent appraisal (less than a year old) of your real estate and/or personal property (such as jewelry, guns, antiques, etc.) bring a copy with you, or bring a broker’s letter of value as to your immovable property

 _____  List all bills you owe, including the following information for EACH bill:

a.         Name, address, ZIP code

b.         Date account was opened.  (month & year)

c.         What the bill is for (clothing, furniture, doctor, etc.)

d.         Total amount owed.

e.         If there is a collection agency or attorney collecting the bill, also show the name, address, and ZIP code of the agency or attorney.

f.          If its a secured debt (home, car, appliances, etc.) a copy of the security agreement, promissory note, mortgage, etc.) which you signed at the time of opening the account.  If you do not have a copy of the agreement securing the debt, list the item(s) securing the debt and the payoff on secured loans.

g.         List all payments in excess of $300.00 made to creditors within the past 12 months whether fully paid off or with a current balance.

_____   The address of each and every place you have lived for the past 2 years.

_____   Listings from Kelly Blue Book (www.kbb.com) as to any vehicles you have ownership interest.

_____   Certificate of title or registration of all vehicles/boats/trailers/mobile homes in which you have ownership interest and a value of said items.

_____   Copies of any succession/estate proceedings to which you are a party and to which you may have an interest, but have not received and/or listing of inheritance assets.

_____   Listing of any transactions involving real estate within the last two (2) years and copies of same.

_____   Your Social Security Number (if a corporation, the Federal I.D.# and incorporation date) and social security card if in your possession.

_____   For each bank account you have had in the past 2 years, the following information:

a.         Name, address, ZIP code of the bank.
b.         Account number; type of account (savings,
            checking, etc.)
c.         Full name and address of each and every person
            authorized to sign checks.
d.         Last six (6) months statements on any and all accounts, open or closed.
              

____     A complete list of any and all attorneys with whom you have pending litigation within the past year, including:

                       a.   Name, address, ZIP code.
                       b.   Dates each were consulted.
                       c.   Dates and amounts paid to each attorney.

_____   All life insurance policies (only with cash value), savings bonds, stock certificates, 401(k) retirement and pension funds, annuities, etc.

_____   Current credit report from annualcreditreport.com (a free report).  Need all three (3) reports available from this site.  If my office runs this report, there is a $35.00 charge.
